Independence notice. nanobananaimg.art operates as an independent AI image generation and editing service. It has no ownership, affiliation, sponsorship, or endorsement relationship with Google, Alphabet Inc., or any of their subsidiaries. References to third-party AI models, technologies, or brands are provided only for descriptive purposes. All trademarks, service marks, logos, model names, and proprietary technologies remain the property of their respective owners. The contractual commitments in these Terms are managed independently and are not tied to any third-party agreements.

Thank you for using Nano Banana. These Terms of Service (“Terms”) govern your access to nano-banana.com, the Nano Banana web application, and any related services (collectively, the “Services”). By creating an account or using the Services you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

  • You must be at least 13 years old to use Nano Banana.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • Provide accurate information when registering and keep it up to date.

2. Credits, subscriptions, and payments

  • Some features require purchasing credits or a subscription. Prices are listed in the app and may change with advance notice.
  • Payments are processed by Stripe or another authorized provider. You authorize us to charge your selected payment method for recurring subscriptions.
  • Credits are non-transferable and, unless required by law, non-refundable once used. Promotional credits may expire.

3. Acceptable use

When using Nano Banana you agree not to:

  • Upload content that violates the law, infringes intellectual property rights, or depicts harmful, abusive, or hateful material
  • Attempt to reverse engineer, copy, or interfere with the Services
  • Use the Services to create misleading content such as impersonations, spam, or deceptive political advertising
  • Circumvent security controls or use automated scripts to overload our infrastructure

We may suspend or terminate accounts that violate these rules.

4. Your content

  • You own the rights to images, prompts, and other content you upload to the Services.
  • You grant Nano Banana a limited, non-exclusive, worldwide license to host, process, and display your content solely to provide and improve the Services.
  • You are responsible for ensuring you have the rights to any third-party content you upload.

5. Generated output

  • Subject to these Terms and applicable law, you may use images generated by Nano Banana for personal or commercial purposes.
  • Nano Banana does not guarantee that generated content will be unique or free from intellectual property restrictions. You are responsible for reviewing outputs before use.
  • You agree not to remove watermarks or attribution when they are applied to preview assets.

6. Privacy and data

Our Privacy Policy explains how we collect and use personal information. By using the Services you consent to those practices.

7. Service changes and availability

  • We may modify, discontinue, or suspend features at any time. We will provide notice of material changes when feasible.
  • Nano Banana may experience downtime as we perform maintenance or respond to incidents. We are not liable for unavailability or data loss.

8. Disclaimer of warranties

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent allowed by law:

  • Nano Banana will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data.
  • Our aggregate liability for any claim relating to the Services will not exceed the amount you paid to Nano Banana in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Nano Banana and its team from any claims, damages, or expenses arising from your use of the Services, your content, or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Services before the new Terms take effect. Continuing to use the Services after the changes become effective constitutes acceptance of the revised Terms.
